Mandate
SOLE AND EXCLUSIVE RENTAL MANDATE
I/We, the undersigned, Lindiwe Ndlovu (ID: 870315 **** 08 *), hereinafter referred to as "the Owner", being the registered owner of the property situated at:
8 Benmore Road, Benmore Gardens, Sandton, 2010
do hereby grant sole and exclusive mandate to Apex Properties, hereinafter referred to as "the Agent", to let and manage the said property on my/our behalf, subject to the following terms and conditions:
1. RENTAL AMOUNT
The property shall be let at a monthly rental of R18,500.00, escalating annually by 8% or as otherwise agreed between the parties.
2. DURATION OF MANDATE
This mandate shall commence on 1 April 2026 and shall remain in force for a period of twelve (12) months, renewable automatically unless cancelled by either party giving sixty (60) days written notice.
3. COMMISSION
The Agent shall be entitled to a management fee equal to 10% (excl. VAT) of the gross monthly rental collected, payable monthly in arrears. A placement fee equal to one month's rental (excl. VAT) shall be due upon securing a new tenant.
4. AGENT'S OBLIGATIONS
The Agent undertakes to: (a) market the property and procure suitable tenants; (b) conduct credit checks and reference verifications; (c) prepare lease agreements in accordance with the Rental Housing Act 50 of 1999; (d) collect rental and deposit monies, to be held in a trust account in compliance with the Estate Agency Affairs Act 112 of 1976.
5. OWNER'S WARRANTIES
The Owner warrants that: (a) the property is free of any structural defects that would render it uninhabitable; (b) the property complies with all applicable municipal by-laws and building regulations; (c) the Owner holds valid title to the property and has the authority to enter into this mandate.
6. DEPOSIT AND TRUST ACCOUNT
All tenant deposits shall be held in an interest-bearing trust account as prescribed by the Rental Housing Act. Interest accrued shall be for the benefit of the tenant unless otherwise agreed in the lease agreement.
7. TERMINATION
Either party may terminate this mandate by providing sixty (60) days written notice. Upon termination, the Agent shall provide a full account of all monies held and transfer any remaining funds to the Owner within thirty (30) business days.
